I believe the difference is that it wasn't a team-wide planned action, and also mostly because it did not actually happen.

Ethically it's fucking ridiculous from JEV to ask that, but rule-wise you have no grounds to penalise someone for saying something stupid/illegal orally over the radio with zero actual consequence.
