Not refuting/rebutting = accepted the statement as truth in Law.
By not refuting it she is admitting to saying it, but it doesn't mean what she said is actually true.

From little I know of the case it sounds like a he said/she said credibility trial.

Yeah that's the way I see it, either she has a really good lawyer who's told her not to deny saying it regardless of how truthful it is, or a really dumb one with SATs level knowledge of civil law.

If she denies it, there are so many other people who she told that the judge/jury is going to believe them, meaning she's lied under oath = case lost, if she doesn't deny it, then the truthiness of the statement is immaterial, but it questions her creditibility (someone who genuinely believes they are a trained assisin when not, isn't a reliable witness). etc. etc.

Surely someone has sat down and explained the consequences of all this, right? She's playing with fire big time, if she looses this, then there's nothing stopping her husband going after custody of her son again, and frankly given the testomy entered so far, I wouldn't blame him if he did even if she won...

Well then if she's not a trained assassin, it doesn't look good for her case. Her saying that to people just makes it look like she is a bitter ex girlfriend and wanted to hurt Kurt's career... even more so than he has himself.

If she loves him so much and wants to help him, then why is she dragging him through the courts?

Sometimes, no matter how much you love someone, if they don't want help, you just have to respect their wishes and wait for them go come to you, dragging them through the court to 'highlight' the error or their ways to them, is not the way you do it.

P.S. wasn't the protective order the equivalent of a UK restraining order, whereby Busch is ordered to stay away from her, because she is in fear for her wellbeing? That's not how you help someone you love.... love.
