That is probably the closest, but that only went to the Contract Recognition Board and Button eventually paid with his own money to drive for BAR. He didn't go to the Supreme Court the day before the race.

Probably because both sides where sensible and more importantly able enough to settle things before it got this far.

Looking at how things have gone I assume vdGarde did try the out of court settlement thing but Sauber (or at least Moneysha) refused any solution.

Maybe Sauber need to pay wages or to the suppliers and need money upfront.

Because if they give him a seat they must repay someone who pays more for the same seat. And paying Giedo isn't an option either because they're basically broke.

Sauber acted out of survival hoping Giedo or Sutil wouldn't sue them.

Frankly, if you have to resort to these measures to survive you're fucked anyways and I doubt they would have finished the season even without vdGarde and Sutil suing them.

It's quite possible Renault will come in with some money to buy the team during the European 3-week summer break.

As for Monisha K, I think it'd be to early to pin the mess on her, although it would be funny to play 'Pin-the-tail-on-the-donkey'... lol

The thing about arbitration is that both sides have to enter into it willingly. So Sauber were interested in settling out of court...right up until the point the arbitration panel found that Giedo had a watertight case.

Didn't Arrows still transport its cars to the Belgian GP?
